以下使用條款規定了名為“港書館 HK BOOKS BORROWING AND SHARING CENTER IN UK”的網上平台（以下簡稱“本平台”）所有使用者的條款和條件。
書藉借閱
本平台作為於本平台上分享或上架的所有書藉的各自書主的獨家代理人處理所有在本平台分享和上架的書藉的借閱事宜。註冊為用戶後，讀者可在本平台借閱書藉。任何人註冊為用戶同意根據本平台的私隱通知(Privacy Notice)並向本平台提供全名、有效電子郵箱地址、郵寄地址和在英國的手機號碼登記。每名新註冊的用戶在任何時候最多可以借閱三個書藉項目。本平台可根據政策調整每位註冊用戶一次最多可借閱書藉的數量。從註冊用戶收到書籍之日起，每個註冊用戶都可以借閱每本書一個月。通過本平台借書不收取借書費。但是，通過確認借閱書籍，每名註冊用戶不可撤銷地同意在歸還書籍時承擔以二等標準郵件於英國內投寄相關書籍的一次性郵費。郵費金額以英國郵局公佈為準。
本平台確認註冊用戶借書後，當有關書藉可供借閱時，將盡最大努力將所借書籍送達或安排他人送達至註冊用戶提供的地址。所有註冊用戶同意，他們的姓名和地址將提供給管有將要投寄給註冊用戶的書藉的第三方。書籍快將到期前或書籍到期後，本平台將通知並要求相應的註冊用戶歸還圖書，歸還圖書的方法是在一周內通過英國郵局以二等標準郵件將相應書籍投寄給位於英國境內的下一位借閱者或本平台指定的任何人。
凡收到通過本平台借出的書籍的註冊用戶，應立即檢查收到的圖書是否被寫字、劃花或損壞。收到的書藉如有任何狀況，註冊用戶應即時通知本平台。註冊用戶通過本平台借閱的書藉，只要為註冊用戶所管有，無論是否在借閱期限內，不得以任何形式書寫、劃花或損壞書藉，註冊用戶獨自負有妥善保管書籍的責任。如本平台發現註冊用戶遺失書藉，或污損、損壞、劃花書藉超出本平台可接受標準的，註冊用戶應按本平台要求全額賠償書主，賠償金額是更換圖書的費用(即是購買替換書籍的費用以及將該書籍運送到本平台指定的英國任何地址的所有本地和國際運輸費用) 。
書藉分享
任何打算在本平台上分享他的書藉並將其書藉借給本平台註冊用戶的人，無論是否在英國，都可以向本平台申請並提供打算分享和借出的書藉的詳細資料。本平台有唯一和絕對酌情決定權決定接受該書藉在本平台上分享，並由本平台借出給本平台的註冊用戶。書藉借出者同意根據本平台的私隱通知(Privacy Notice)並向本平台並提供姓名、電郵地址和電話號碼。
通過向平台申請分享和借出書籍：
(i) 借出者 (即“書主”) 聲明該書由書主單獨擁有，任何其他方對該書沒有任何利益;
(ii) 書主同意本平台作為其通過本平台分享其書藉、借出其書藉予本平台註冊用戶的全權代理，並授權本平台按照本使用條款中的規定處理書籍一切事宜;
(iii) 書主承認將其書籍透過本平台借出和投寄給本平台的各註冊用戶的過程不可避免地涉及丟失或損壞的風險，雖然本平台根據本條款將盡最大努力保護書主對相關書藉的利益，並因特定註冊用戶造成的損失或嚴重損害向該註冊用戶索取賠償，書主同意，在任何情況下，本平台，包括其任何管理人員、員工、代理人或義工，均不對書藉的任何損失或損壞向書主承擔責任; 及
(iv) 書主同意，為保護本平台註冊用戶的私隱，註冊用戶的姓名等個人資料不得向相關書主透露。
一旦本平台接受書主在平台上分享和借出其書藉的申請，“共享圖書”部分的條款將生效並持續有效一個月，並且將每月自動續期一次，除非任何一方書面要求不再續約。
一般條款
所有註冊用戶和書主透過繼續使用本平台，即表示同意受本平台不時修訂的這些使用條款的約束。
本使用條款取代本平台與所有註冊用戶和書主之間的所有口頭或書面協議和諒解以及本平台中聲明的任何其他條款或陳述。
這些使用條款應受英格蘭和威爾士法律管轄並根據其解釋，各方同意服從英格蘭和威爾士法院的專屬管轄權。
中文版使用條款僅為方便讀者而設。如有任何差異，應以英文版使用條款為準。

The following terms of use sets out the terms and conditions for all users of the online platform bearing the name “港書館 HK BOOKS BORROWING AND SHARING CENTRE IN UK” (referred to as the “Platform” hereafter).
Borrowing of books
The Platform acts as the sole agent on behalf of all the respective bookowners of all books shared or listed on the Platform in handling the borrowing of all the books shared and listed on the Platform. After registration as a member, reader may borrow books from the Platform. Anyone who register as a member agree to provide their full name, valid email address, delivery address and mobile phone number in the United Kingdom for registration in accordance with the Privacy Notice of the Platform. Each newly registered user is allowed to borrow up to three book items at any time. The Platform may adjust the maximum number of book each registered user may borrow at a time according to its policy. Each registered user is allowed to borrow each book for one month, from the date when the book is received by the registered user. No borrowing fee is charged for the borrowing of book(s) through the Platform. However, by confirming the borrowing of book(s), each registered user irrevocably agrees to bear the postage for one-time delivery of the relevant book within the United Kingdom by second class standard post when returning the book(s). The amount of the postage is subject to the changes announced by the UK post office.
After confirming the borrowing of book(s) by the registered users, the Platform will use it best endeavour to deliver, or procure other parties to deliver the book(s) requested to the address as provided by the registered user if and when the relevant book is available. All registered users agree that their names and the addresses will be provided to the respective third party(ies) who is in possession of the book to be delivered to the registered user. Shortly before the book is due or after the book is due, the Platform will inform and request the respective registered user to return the book, by sending the respective book to the next borrower or any person designated by the Platform in the United Kingdom by second class standard post of the UK post office within one week.
All registered users who receive any book borrowed through the Platform shall check immediately if the book(s) received is annotated, marked or damaged. If there is any condition(s) with the book(s) received, the registered user shall promptly report to the Platform. As long as a registered user is in possession of the book(s) borrowed through the Platform, regardless whether it is within the borrowing period of not, the book must not be annotated, marked or damaged in any way, and the registered user shall have the sole responsibility in taking due care of the book(s). If it is found by the Platform that a registered user loses any book, or stains, damages or scratches any book beyond a standard acceptable to the Platform, the registered user shall, on the request of the Platform, compensate the bookowner for the full replacement cost of the book (i.e. the cost of buying a replacement book and all the local and international transportation cost of bringing that book to any address in the United Kingdom designated by the Platform).
Sharing of books
Any person whether in the United Kingdom or not who intends to share his book(s) on the Platform and lend his book(s) to registered users of the Platform may apply to the Platform with details of the book(s) to be shared and lent. The Platform may, at its sole and absolute discretion, accept the book(s) to be shared on the Platform and to be lent to registered users of the Platform by the Platform. The Platform does not take any transaction fee. Book lender agrees to provide the name, email address and phone number to the Platform in accordance with the Platform’s Privacy Notice.
By making such application to the Platform for the book(s) to be shared and lent,
(i) the lender (the “Bookowner(s)”) declares that the book(s) is in the sole possession of the Bookowner, and no other party(ies) has any interest in the book(s);
(ii) the Bookowner agrees that the Platform acts as his sole agent on behalf of the Bookowner in sharing his book(s) through the Platform and lending his book(s) to registered users of the Platform, and authorises the Platform to deal with the book(s) on terms as set out in these terms of use;
(iii) the Bookowner acknowledges that the process of lending and delivery of his book(s) to various registered users of the Platform through the Platform inevitably involves risk of loss or damage, and that while the platform will use its best endeavour in protecting the interests of the Bookowner in the relevant book(s) and obtaining compensation from registered user(s) in case of loss or serious damage that is attributed to a particular registered user in accordance with these terms of use, the Bookowner agrees under no circumstances should the Platform, including any of its management, staff, agent or volunteer be liable to the Bookowner for any loss or damage whatsoever of the book; and
(iv) the Bookowner agrees that, for protection of privacy of the registered users of the platform, the personal details of the registered users including their names shall not be disclosed to the relevant Bookowner.
Once the Platform accepts the Bookowner’s application to share and lend his book(s) on the Platform, the terms under the section headed “Sharing of books” will take effect and last for one month, and will be automatically renewed every one month unless either party requests in writing not to renew it for another term.
General terms
By continuing to use the Platform, all registered users and Bookowners agree to be bound by these terms of use as amended by the Platform from time to time.
The terms of use shall supersede and replace all prior agreements and understandings, oral or written, between the Platform and all registered users and Bookowners and any other terms or representations stated in the Platform.
These terms of use shall be governed by and construed in accordance with the law of England and Wales and each party agrees to submit to the exclusive jurisdiction of the courts of England and Wales.
The Chinese version of terms of use is the convenience of readers only. In case of any discrepancy, the English version of the terms of use should prevail.
